Time to ante up

First of all folks, this post is “sticky”, meaning it will always be at the top of the main page. When we reach our goal of $5,000, I will allow it to take its proper place in the date sequence. However, there are NEWER posts just below – so don’t sign on, look at this top post and then leave thinking we have not posted anything new.

Our tally is up to $2200. I listed another painting for auction on eBay this afternoon. It is a local establishment, Carney’s in Cape May. Bids begin at $50, and proceeds benefit the Legal Defense Fund.

I created a page with a PayPal Donate Button. Click the button to the left or the link, and it will take you to a page with the button that will allow you to donate using your credit card on a secure server. You do not need to be a PayPal member to use this feature. In addition, I have placed two of my paintings up for auction on eBay.

“Jack, the Evil Bartender” from the Erin Rose, the first painting I auctioned for the defense fund sold. This case is raising eyebrows across the country to those that follow 1st amendment lawsuits, and this painting was purchased by a fan in California.

“Captain Tony’s” in Key West was the second painting I place up for auction, and it too sold. This was purchased by a long-time  local supporter of the site.

Every dollar counts, so if you feel that this blog has been a service to the voters of Cumberland County, I am asking for a favor in return. The legal defense will be very expensive. This is a shallow attempt by the unholy forces of the Camden County Democratic Machine and Cumberland County Democratic Organization to extinguish free speech in Cumberland County. This lawsuit is an affront to the constitution. If they succeed in shutting this site down, it will send an icy chill on political discourse throughout the state, regardless of which party is in control.

I want to publicly thank everybody that has been so generous in this trying economy, with donations that did outpace my expectations.

    As soon as somebody speaks out about the corruption rampant in this county the only thing they can think about is censorship. This lawsuit is punishment for making them actually have to campaign for office and still losing a seat this year.

    I can not believe your begging for money. Standing by The first amendment. This site is just all gossip. It’s just a bully hiding behind a screen. Maybe you should have thought about the consequences, especially when you have diarrhea of the mouth. Are you going to beg for money when the judge says you have to pay for damages? Just remember the statue Of limitations for libel/slander is a year. There is still time for others to file. As much as you may think that this is a political website it’s not, I really don’t the first amendment is going to help you. Better start calling The National Enquier or Star.

    Here is the standard: You cannot THINK or BELIEVE something is libelous. You, as the plaintiff, must prove that not only what was posted was false, but that the author knew AHEAD OF TIME the allegations were false and posted allegations as KNOWINGLY false.
    As for Carl’s opinions on the subject, they are just that, opinions protected by the first amendment. If I said that I believed that WILDWITCH was a chronic bedwetter, it is just that, a belief or opinion, as long as it wasn’t posited as fact. And all of this must be proven. Since they are elected officials, the burden of proof is set even higher because they are public figures.
    Instead of throwing childish tantrums, Mr. Long should just start his own website and counter anything he believes is misleading on Carl’s part. But, instead, we have the “tolerant” and “diverse” democrat party trying to squash free speech just because they disagree with what is being said.
    As I’ve always said, fascism will come to America in the name of anti-fascism. I give you the democrat party (posited as an opinion, of course).

How can one person with no cash flow be a bully when the entity he is supposedly beating up on has hundreds of thousands of dollars flowing through its coffers annually? The bullies here are Doug Long, the CCDO, the Democrat Freeholders that are using their deep pockets in a blatant attempt to shut down this site and others.

    They have a big election next year, and want to win back the majority they so carelessly lost. they know that this site and others make a marked impact by reporting news and digging deeper than the local media is willing to do. The local media could not have cared less about NACo.

    And as far as begging – your D’s “beg” for donations all the time, just read their ELEC reports! But apparently according to you, the only people that should be allowed freedom of speech are those that are independently wealthy! If Bill Whelan and Doug Long are allowed to have their way, there will be no free speech in Cumberland County – only that speech which passes their standards of approval.

    Why do I include Whelan? because as freeholder director he has a DUTY to protect the 1st Amendment, and once again he is silent. His handlers, courtesy of the Camden Machine pull his strings. He lacks the backbone to make the right decisions, and that is a shame.

    Thanks for the clarification, as a victim of your deposed leader, I appreciate you clearing this up for me. But then again, I have already spoken to my attorney and know the laws. Especially when I have produced all documents, televised interviews, you tube videos and newspaper articles to my attorney.
    Might I remind you that you and all the others who come here under your “feminine” pseudonyms are exercising your first amendment right on a site that you claim prints falsehoods. You can’t have 2 sets of rules here on the postings.

    The Truth,
    Since libel is by definition false, if a Journalist reports something that is True it CANNOT be Libelous, even if it Damages a person’s Reputation.
    Truth is the reporter’s best defense against a libel suit.

    Privilege Accurate reports about official proceedings – anything from a murder trial to a city council meeting or a congressional hearing – cannot be Libelous. This may seem like an odd defense, but imagine covering a murder trial without it. Conceivably, the reporter covering that trial could be sued for libel every time someone in the courtroom accused the defendant of murder.

    Fair Comment & Criticism:
    This defense covers expressions of opinion, everything from movie reviews to columns on the op-ed page. The fair comment and criticism defense allows reporters to express opinions no matter how scathing or critical. Examples might include a rock critic ripping into the latest music CD, or a political columnist writing that she believes the President is doing a horrible job.

    Public Officials vs. Private Individuals

    In order to win a libel lawsuit, private individuals need only prove that an article about them was libelous, and that it was published.

    But public officials – people who work in government at the local, state or federal level – have a tougher time winning libel lawsuits than private individuals.

    Public officials must not only prove that an article was libelous and that it was published; they must also prove it was published with something called “actual malice.”

    Actual malice means that:

    The story was published with the knowledge that it was false.
    The story was published with reckless disregard of whether or not it was false.

    Times vs. Sullivan:

    This interpretation of libel law comes from the 1964 U.S. Supreme Court ruling Times vs. Sullivan.
    In Times vs. Sullivan the court said that making it too easy for government officials to win libel suits would have a chilling effect on the press and its ability to aggressively report on the important issues of the day.

    Since Times vs. Sullivan, the use of the “actual malice” standard to prove libel has been expanded from just public officials to public figures, which basically means anyone who is in the public eye.

    Put simply, Celebrities,Politicians, Sports Stars, High-Profile Corporate Executives and the like all must meet the “actual malice” requirement in order to win a Libel Suit.

    For journalists, the best way to avoid a libel suit is to do responsible reporting. by Investigating wrongdoing committed by powerful people, Agencies and Institutions, always make sure you have the facts that back up what was reported.

    GUESS WHO…well done. In a nutshell, WILDWITCH is trying to make a case where there is none. Actual malice is proven when the plaintiff proves what was reported was knowlingly false and published the information with reckless disregard. None of this can be proven by the CCDO. Carl is also entitled to first amendment right to free speech to comment on issues of the day involving government.
    If I’m Carl, I have this case dismissed quickly, then file a bar complaint against Mr. Long for frivilous lawsuit, citing Rule 3.1 of the Model Rules of Professional Conduct, Meritorious Claims and Contentions.

  18. Good Luck Carl I hope the Judge takes this case and dissmiss it. If not it would be a sad day for our First amendment rights. Also for what our veterans fought for. If I was in New Jersey I would be in court to see what happens.

    @Alex – that won’t happen today. Today we move to have the case changed from a summary action – which is an improper move by the plaintiff to turn this into a kangaroo court trial – and make it a plenary action which will be public.

    The plaintiff doesn’t want the details of the case to be public – well, regardless of the outcome it WILL be public.

    I will likely have to return to court in a month, after both parties have time for discovery, at which point we will move for dismissal due to lack of plaintiff being able to meet the basic requirements to even bring a case.

    I am considering options for a counter-suit. As always, MWatch readers will be the first to read about it!
